Notice on Company Formation:

PflegeHerz Consulting UG (limited liability) is currently in the process of formation. 

No taxable business activities are being conducted at this time. All information and services provided on this website are solely intended to prepare for future commercial operations.

Note on Brand Structure:
The subdivisions “PflegeHerz Academy,” “PflegeHerz 4Kids,” “PflegeHerz Welcome,” “PflegeHerz Alumni,” and “PflegeHerz Legal” are functional parts of the umbrella brand PflegeHerz Consulting. They are not legally independent entities but represent specialized initiatives managed under the responsibility of PflegeHerz Consulting – Owner: Poulose Reichelt.


§ 1 Scope of Application
These General Terms and Conditions (GTC) apply to all contractual relationships between PflegeHerz Consulting, Poulose Reichelt, Evinger Str. 195, 44339 Dortmund, Germany (hereinafter “PflegeHerz Consulting”) and its business clients (hereinafter “Client”), particularly in the context of the international recruitment and integration of nursing professionals from the Republic of India, especially from the state of Kerala, into the German healthcare sector. Deviating terms shall only apply if confirmed in writing.


§ 2 Scope of Services
PflegeHerz Consulting offers services for the recruitment, pre-selection, language preparation, recognition support, travel organization, and cultural and professional integration of international nursing staff in Germany.

Services include, but are not limited to:
(a) Assessment and pre-selection of suitable candidates
(b) Organization of German language training up to level B2
(c) Full application submission according to the German Nursing Professions Act (PflBG), including deficit notification, adaptation program, or knowledge exam
(d) Coordination with regional authorities, language schools, and employers
(e) Organization of visa, travel, accommodation, and health insurance
(f) Creation, review, and secure digital transmission of all required documents
(g) Provision of structured process overviews and regular status updates
(h) Recommendations for onboarding and integration

PflegeHerz Consulting guarantees the proper organization and implementation of the above services. A successful outcome (e.g., official recognition or visa issuance) is expressly not guaranteed, as these decisions are made by external authorities (§§ 275, 631 BGB).


§ 3 Ethical Standards
PflegeHerz Consulting commits to complying with the WHO Global Code of Practice on the International Recruitment of Health Personnel. All partners are contractually obligated to follow ethical, transparent, and fair recruitment standards.


§ 4 Client Obligations
The Client agrees to: (a) Provide all necessary and truthful information and documents
(b) Actively participate in needs assessment and candidate evaluation
(c) Timely sign employment contracts with candidates
(d) Cooperate with authorities and support application processes
(e) Ensure an inclusive, non-discriminatory work environment

If service delivery is delayed due to lack of cooperation, PflegeHerz Consulting’s claim to payment remains unaffected (§ 642 BGB).


§ 5 Payment Terms
The total service fee shall be payable in three installments:                                                                                                     (a) 30% upon contract signing: invoiced after the Client signs the service agreement
(b) 40% after submission of recognition documents: proof of complete submission according to § 41 PflBG to the competent authority
(c) 30% upon employment start of the nursing professional: verified via contract, duty schedule, or employer confirmation

A candidate is considered placed once employment commences, regardless of recognition status (§§ 611a, 631 BGB).

Invoices are due within 10 calendar days of receipt (§ 286 BGB).

PflegeHerz Consulting assumes no liability for decisions by authorities or third parties. The company commits only to the comprehensive support and management of the process.

Early termination and replacement:
(d) If the candidate resigns within three months of starting, PflegeHerz Consulting offers a one-time replacement free of charge, unless misconduct or significant failures by the Client caused the resignation.
(e) No replacement is provided if termination occurs after three months. Upon request, a new placement may be offered under separate terms.
(f) No replacement obligation exists if:

  • the Client terminated the contract without just cause

  • the candidate resigns due to unreasonable conditions

  • onboarding or integration support was obviously neglected
    (g) Paid fees will not be refunded.
    (h) The models outlined above reflect the standard billing structure. Custom terms and service bundles may be individually agreed upon in writing (§ 126 BGB).


§ 6 Right of Withdrawal
(a) Withdrawal is only permitted if the service agreement has not yet been signed.
(b) After signing, free withdrawal is excluded. A cancellation after signing but before the employment start incurs a 65% cancellation fee.
(c) After employment begins, no withdrawal is possible; the full service fee is due (§ 648 BGB).


§ 7 Liability
PflegeHerz Consulting is liable only for damages caused by gross negligence or intent (§ 276 BGB). No liability is accepted for: (a) Language or exam results
(b) Recognition or visa decisions by authorities
(c) Work performance or behavior of the placed candidate


§ 8 Data Protection
Data processing complies with the General Data Protection Regulation (GDPR) and the German Federal Data Protection Act (BDSG). See: www.pflegeherzconsulting.de/datenschutz


§ 9 Confidentiality and Intellectual Property
All documents, candidate profiles, and processes are confidential and protected by copyright. Any reproduction or transfer to third parties requires prior written consent (§§ 2, 31 UrhG).


§ 10 Language and Interpretation
This English version is provided for convenience only. The original German version is legally binding. German law applies.


§ 11 Jurisdiction
Place of jurisdiction is Dortmund, Germany, insofar as legally permissible (§ 38 ZPO).


§ 12 Severability Clause
If any provision is deemed invalid or unenforceable, the validity of the remaining provisions shall remain unaffected (§ 306 BGB).


§ 13 Voluntary Social Projects (PflegeHerz 4Kids)
PflegeHerz Consulting supports voluntary social initiatives, especially “PflegeHerz 4Kids”. These are not part of the contractual services. No legal claims exist regarding their content, duration, or participation. PflegeHerz Consulting reserves the right to modify or discontinue such initiatives at any time (§ 241 BGB).

1) The following General Terms and Conditions (GTC) apply to all contracts, services and offers between PflegeHerz Consulting, Owner: P. Reichelt, Evinger Str. 195, 44339 Dortmund (hereinafter “PflegeHerz”) and the client (hereinafter “Client”), unless expressly agreed otherwise in writing. 

(2) Clients within the meaning of these GTC are exclusively entrepreneurs pursuant to Section 14 of the German Civil Code (BGB), in particular care facilities, hospitals, clinics, rehabilitation centers and outpatient care services based in Germany. 

(3) Conflicting or deviating general terms and conditions of the Client shall only apply if PflegeHerz expressly agrees to their validity in writing. This also applies if PflegeHerz performs services unconditionally in the knowledge of conflicting conditions.
